What is the professional “standard of care?”

Professionals aren’t expected to be perfect.

They are expected, however, to exercise the same degree or level of care that is exercised by other members of that profession in the same or similar circumstances. This is referred to as a duty to comply with the applicable standard of care.

What standard of care applies depends on the profession or specialty of the negligent professional, as well as the facts of the case. For example, a cardiologist must exercise the same degree or level of care as that exercised by other cardiologists in the same or similar circumstances.
