Zoll, Kranz and Borgess provides representations to individuals who may have been harmed by the misconduct of a professional. Claims such as these are called malpractice claims, and are most often seen in the medical and legal profession, but may even be brought against accountants, engineers, architects, or real estate brokers. All professionals are and should be held accountable for the services provided to their clients. When these services are well below the accepted standard of care or practice for that particular profession, liability for the misconduct may exist.

There is no cost to the client for an evaluation of a case. If we accept the case, we are only paid if we are successful. Zoll, Kranz and Borgess welcomes the opportunity to review any potential malpractice claim.

Medical malpractice claims may be brought against hospitals, nursing homes, doctors, nurses, psychiatrists, dentists or even pharmacists. A medical malpractice may occur when a medical provider either fails or delays diagnosing a condition, fails to provide the proper treatment or therapy, fails to properly perform a surgical procedure, fails to refer a patient to a needed specialist, or even when that provider fails to provide adequate and truthful information to a patient regarding the possible risks and/or complications from a procedure, device, or medication.

Legal malpractice claims may be brought against an individual attorney, the law firm, or one of the support staff for a law firm. For example, legal malpractice may occur when a legal provider fails to meet deadlines.

Other professional malpractice follows the same principles set forth above and may arise at any time professionals fail to perform their duties to the best of their abilities.

We do not take frivolous lawsuits. Pursuit of a frivolous case does not help the client or the attorney. Instead, we carefully review each case to insure that each of the following requirements have been met:

  • Did the professional breach a duty owed, such as a failure
    to act in accordance with the applicable standard of care?

  • Did this breach of duty cause serious harm?

We retain other professionals, such as board certified doctors, to review the claims, and insure a fair and complete evaluation of each case.

Examples of recent successful claims include crippling birth injuries, death from infection, failure to diagnose and treat serious heart conditions resulting in death, falls from hospital beds or wheelchairs causing death or brain injury, failure of an accountant to discover fraudulent conduct, and failure of an attorney to file a claim promptly.
