A product liability claim arises when a defective product causes injury to a person or property. There are three main categories designated for defective products that may result in product liability claims:

  1. Design Defects – flaws in the item’s design 

  2. Manufacturing Defects – specific defects which occur during the manufacture of the product 

  3. Defects in Marketing - improper instructions or a failure to explain dangers in the product. 

Any product can be defective and cause injury. Some examples of common defective products that have caused injuries include, but are not limited to, the following:

  • Automobiles and Automobile Products (including Tires, Car Seats, Safety Belts Seats, and Brakes.) 

  • Medicines (Pharmaceuticals, Over-The-Counter, Prescriptions, Diet Pills, Homeopathic Solutions, etc.) 

  • Medical Devices and Rehab Heath Care Products (including replacement hips, implants, etc.) 

  • Household Items 

  • Foods 

  • Baby Products 

  • Children's Toys 

  • Sporting Goods
